When either your realtor helps you to find a new home or you find it on your own and you are ready to make an offer on a new home, as a buyer, your Realtor will have you sign a contract offer. Along with a pre-qualification letter, if you are going to get a mortgage, your realtor will submit your offer to the listing Realtor and they will submit your offer to the seller.
When the seller accepts your offer, both the listing realtor and your buying realtor will forward the signed contract offer to the sellers attorney and your buyer’s attorney.

First, we immediately open your file for Attorney Review
The Attorney Review Period is a federal right given to every buyer and seller of residential real estate, when the buyer or seller is represented by an attorney. It is a 3 day period whereby the buyer or seller has the opportunity to have their contract reviewed by their attorney. Anything and everything in the contract is negotiable during this period of time. This is not overstated. In fact, the contract can be cancelled for no specific reason whatsoever.
Most buyers and sellers want to “conclude attorney review” as quickly as possible.
Buyers want to conclude attorney review so that they have some assurance that the seller will not accept another offer.
Sellers want to “conclude attorney review” so that they have some assurance that they have a buyer in tow, giving them certainty that they will be selling their property.
Next, one of our knowledgeable, experienced attorneys call you.
We want to get to know you and to learn about any concerns or questions that you may have about both the property and the contract. Being sensitive to your concerns, he will make note of them and modify the contract accordingly.
The Attorney Review Letter will be sent to the attorney on the other side.
During the Attorney Review Period, the attorneys will communicate, each advocating for their respective clients, and very quickly the Attorney Review Period will be concluded.
Once, Attorney Review is Concluded, we move into the Inspection Period.
It is highly recommended that every buyer orders and inspection of the property they are buying. This inspection, in order to be credible and actionable, must be done by a certified home inspector, (not a friend in construction or a general contractor).
The inspector will walk through the house with the buyer and inspect everything from the dust on the basement floor to the top of the roof shingles and everything in between.
Either that day or within a few days, depending upon his/her technology, a report will be generated.
The Inspection Report
Once the Inspection Report is generated and received by our office, we will forward it to you, as the buyer, and discuss with you which items, if any, you’d like repaired, replaced and/or for which items you’d like a monetary credit.
We, on your behalf, will send your request to the attorney on the other side of the transaction. Upon agreement between you and the seller, we will conclude the Inspection Period.
The Mortgage Contingency Period
Upon conclusion of the Attorney Review Period and the Inspection Period, we focus on the Mortgage Contingency Period as laid out in the Real Estate Contract.
In the contract, there is a date certain time frame in which the buyer must prove that they are able to obtain a mortgage approval.
A mortgage approval, for purposes of this contingency period, is an approval with conditions. This does not mean that there is a guarantee that the buyer will obtain a mortgage from a particular lender. It means that the buyer applied for a mortgage with a lender and based upon preliminary information, provided by the buyer, the lender approved the mortgage with “conditions”.
There are times that the conditions are minimal, as in a title report and an appraisal report. Other times, the conditions are more voluminous and onerous, as in further proof of income, assets and other debt issues. As long as the lender issues the Approval with Conditions within the Mortgage Contingency Clause period as stipulated in the Contract, then it is satisfied.
However, it does not assure the seller that the buyer will actually and finally qualify for the mortgage. Unfortunately, there are times that they buyer cannot satisfy all of the conditions and will still be denied a mortgage. Beyond the attorney review period and the inspection period, where it appears that there is certainty for both buyer and seller, the final approval, clear to close and funding of a purchase is one area where the deal can fall through even at the end of the transaction.
